Acting Essex County Prosecutor Carolyn A. Murray stated today the Essex County Prosecutor’s Office has not filed charges against the two students who were involved in an incident that ended with the death of Gian Davis, 30, of Newark.
The investigation remains active and ongoing but the preliminary results indicate the two Essex County college students were walking in the 300 block of Bloomfield Avenue at approximately 1:30 am on Sunday when Davis approached them. When one of the students took out his phone, Davis knocked him to the ground. Davis also assaulted the other student who came to the aid of his friend. Davis was restrained by the students who called 911. Video surveillance from the area of the incident has been recovered.
Both students, who are currently residents of Newark, remained at the scene until the police arrived. Davis was transported to University Hospital and died about an hour later.
The students have been cooperating with law enforcement since the event occurred. The identity of the students is not being released at this time since they have not been charged and the investigation remains active. When the investigation is completed the matter may be presented to an Essex County grand jury for review.
